EUIPO's Fast Track does not eliminate any of the mandatory stages of the procedure \u2014 it enables the application to reach publication more quickly. Among the key conditions: goods and services must be selected exclusively from EUIPO's Harmonised Database, and the fee must be paid at the time of filing. But these two conditions are not sufficient on their own. The application must not be for a collective or certification mark, and the applicant may not request a national or European search within the same application. Where the applicant claims priority or seniority, the relevant data and supporting documents must also comply with Fast Track requirements \u2014 claiming priority or seniority in itself does not exclude accelerated processing. An applicant who does not have a domicile or principal place of business in the EEA must immediately appoint a suitable representative \u2014 failing to do so causes the application to lose Fast Track status before examination even begins.<\/p>\n
If an application ceases to meet the Fast Track conditions during processing, EUIPO transfers it to the standard examination route. According to EUIPO's official data, Fast Track applications are published in half the time or less compared with the standard route. This applies only to the pre-publication stage, however: after publication, the mandatory three-month opposition period applies in any event \u2014 so Fast Track does not shorten the overall procedure by the same margin by which it accelerates examination.<\/p>\n

The key actions here are: selecting Nice classes<\/a>hat accurately reflect the actual field of activity; searching for earlier identical and similar trade marks in the relevant databases; and assessing the risk of conflict with earlier rights. Typical strategic errors at this stage<\/a> cost considerably more than the preliminary search that could have prevented them.<\/p>\n The first step is to identify the classes of goods and services under the Nice Classification that correspond to the applicant's field of activity. The application form is then completed with the image or other permissible representation of the trade mark, the full list of classes, and the required supporting information. The final step is payment of the official EUIPO fees, the amount of which directly depends on the number of classes claimed.<\/p>\n After filing, EUIPO checks the application for compliance with formal requirements and conducts substantive examination on absolute grounds for refusal \u2014 assessing in particular the distinctive character of the sign and the absence of descriptiveness. Where no obstacles to publication are identified, the application is published in the EU Trade Marks Bulletin. From that point, a three-month period begins during which proprietors of earlier rights may file an opposition against registration. Where no opposition is filed, or any opposition is dismissed, the mark is registered and a certificate is issued \u2014 the official document confirming the proprietor's rights across the entire Union.<\/p>\n The basic online EUIPO fee is \u20ac850 for one class of goods or services. The second class costs an additional \u20ac50, and the third and each subsequent class adds \u20ac150. An excessively broad class specification therefore not only complicates the protection strategy but directly increases the official costs.
